These Terms of Service govern all quotes, estimates, proposals, invoices, work orders, service calls, website use, customer communications, payments, and services provided by FIXIN IT, LLC. By requesting service, approving a quote, scheduling work, paying a deposit, providing a payment method, allowing work to begin, or otherwise doing business with FIXIN IT, LLC, the customer agrees to these Terms of Service.
These Terms are intended to be incorporated into every quote, estimate, invoice, work order, service agreement, and customer communication issued by FIXIN IT, LLC, whether referenced directly, linked electronically, attached, or included by reference.
1. Definitions
For purposes of these Terms: "FIXIN IT," "Company," "we," "us," or "our" means FIXIN IT, LLC. "Customer," "you," or "your" means the person, property owner, tenant, landlord, business, property manager, agent, representative, or other party requesting, approving, paying for, or receiving services from FIXIN IT, LLC. "Property" means the home, business, rental property, building, land, structure, unit, site, or location where work is requested or performed. "Services" means handyman-level repair, maintenance, installation, assembly, replacement, property improvement, inspection, evaluation, cleaning, haul-off, project support, or related services offered or performed by FIXIN IT, LLC. "Quote" means any estimate, proposal, quote, work order, invoice, electronic quote, written scope, price, or service description provided by FIXIN IT, LLC. "Completion" or "Substantial Completion" means the quoted work has been substantially performed or made usable for its intended purpose, even if minor touch-ups, customer-requested additions, warranty review, documentation, or non-critical follow-up items remain.
2. Acceptance of Terms
The customer accepts these Terms by requesting service, approving a quote, estimate, invoice, proposal, or work order, signing electronically or physically, clicking an approval button, paying a deposit, providing a card or payment method on file, scheduling work, allowing FIXIN IT, LLC to enter the property or begin work, sending written, electronic, verbal, text, or email authorization to proceed, or continuing to use our website, services, or communication systems. Electronic approvals, digital signatures, text confirmations, email approvals, online quote approvals, and payment authorizations are intended to have the same effect as a handwritten signature to the fullest extent permitted by law. If the customer is approving work on behalf of another person, property owner, landlord, business, tenant, trust, estate, association, or entity, the customer represents that they have authority to approve the work and bind the responsible party to these Terms.
3. Handyman-Level Service Notice
FIXIN IT, LLC provides practical handyman-level repair, maintenance, installation, assembly, replacement, and property improvement services for small to medium repair, maintenance, improvement, and property support needs. Some projects may require a licensed trade contractor, permit, inspection, engineering review, specialty subcontractor, utility coordination, HOA approval, property management approval, landlord approval, or additional evaluation depending on scope, site conditions, safety, local code, insurance requirements, or hidden conditions. FIXIN IT, LLC reserves the right to refuse, pause, modify, limit, or recommend outside licensed trade support for any work that falls outside appropriate handyman-level scope or presents safety, structural, electrical, plumbing, HVAC, roofing, gas, environmental, hazardous material, code, permitting, or licensing concerns. FIXIN IT, LLC does not represent that every service request can or should be completed as a handyman service.
4. Quotes, Estimates, and Pricing
Quotes are based on information available at the time they are prepared, including visible conditions, customer-provided information, site observations, photos, measurements, descriptions, and reasonable assumptions. Unless otherwise stated in writing, quotes are valid for 7 calendar days. FIXIN IT, LLC reserves the right to revise, withdraw, or reprice any quote before acceptance, after expiration, or if additional information, site conditions, material changes, or scope changes become known. A quote is not a guarantee that the property, existing materials, hidden systems, prior work, or surrounding areas are suitable, safe, code-compliant, or free from defects. A quote is not a full home inspection, engineering evaluation, code inspection, mold inspection, pest inspection, structural analysis, plumbing inspection, electrical inspection, HVAC inspection, roof inspection, or warranty of the property.
5. Scope of Work
The approved quote includes only the work specifically described in writing. Any item not specifically listed is excluded unless added by written or electronic change order, approved message, approved invoice, or other written confirmation from FIXIN IT, LLC. Photos, walkthroughs, verbal conversations, general descriptions, or customer assumptions do not expand the scope unless clearly included in the approved quote or change order. FIXIN IT, LLC is not responsible for work assumed, implied, discussed casually, requested after the quote, or expected by the customer but not included in the written scope. Additional work requested on site may be billed separately and may affect schedule, completion, pricing, and material needs.
6. Change Orders and Additional Work
Work outside the original approved scope may require additional pricing and approval. Change orders may be approved by signature, email, text message, electronic approval, verbal authorization, payment, or other clear communication. Additional work may include hidden damage, rotten or deteriorated materials, additional repairs discovered during work, customer-requested upgrades, material changes, additional labor time, return trips, disposal or haul-off, specialty tools or equipment, subcontractor involvement, permits, approvals, inspections, or work needed to make the original scope possible. FIXIN IT, LLC is not required to perform extra work without additional compensation.
7. Unknown, Hidden, and Unforeseen Conditions
Quotes are based on visible and reasonably apparent conditions. Repairs may involve unknown, hidden, concealed, or pre-existing conditions that cannot be fully identified before work begins, including rotten wood, water damage, mold, mildew, moisture intrusion, termite or pest damage, hidden plumbing leaks, unsafe wiring, improper prior repairs, code violations, damaged framing, structural deficiencies, foundation or drainage issues, unsafe materials, deteriorated siding, trim, decking, flooring, roofing, subflooring, buried utilities, hidden irrigation, low-voltage or drainage lines, asbestos, lead paint, silica, sewage, biohazards, manufacturer defects, missing blocking, backing, support, framing, or improper installation by others. If discovered, FIXIN IT, LLC may pause work and provide updated pricing, change orders, recommendations, or referrals. Additional labor, materials, equipment, subcontractors, disposal, diagnostics, delay time, or return visits will be billed separately. The customer is responsible for these costs.
8. Customer-Provided Information
The customer is responsible for providing accurate information regarding the property, service request, expectations, access, existing damage, prior repairs, utilities, materials, safety concerns, and restrictions. FIXIN IT, LLC may rely on customer-provided information when preparing a quote, scheduling work, purchasing materials, or performing services. If information is inaccurate, incomplete, or misleading, additional charges, delays, change orders, or cancellation fees may apply.
9. Customer-Provided Materials
If the customer provides materials, fixtures, hardware, appliances, parts, paint, fasteners, sealants, screens, doors, windows, blinds, curtains, flooring, furniture, equipment, or other items, the customer is responsible for ensuring those items are correct, complete, compatible, undamaged, safe, code-compliant, approved for intended use, and suitable for installation. FIXIN IT, LLC is not responsible for incorrect materials, missing parts, manufacturer defects, shipping damage, poor fitment, wrong size, color, model, finish, incompatibility, warranty issues, product failure, delays, additional labor, assembly, modification, defects, or missing instructions. Additional charges may apply. FIXIN IT, LLC does not warranty customer-provided materials or products.
10. Materials Purchased by FIXIN IT, LLC
Materials purchased, ordered, delivered, opened, modified, installed, cut, mixed, painted, assembled, special-ordered, or otherwise committed to a project are billable to the customer. Special-order materials, custom items, opened materials, used materials, installed materials, delivery charges, handling charges, restocking fees, disposal fees, shipping fees, supplier fees, and non-returnable items are the customer's responsibility. Material pricing may include sourcing, purchasing, pickup, transportation, handling, storage, coordination, returns, and administrative processing. A deposit or full payment may be required before ordering or scheduling work.
11. Scheduling, Delays, and Availability
Scheduling is subject to availability, weather, materials, project priority, emergency calls, subcontractors, customer readiness, traffic, site conditions, safety, and other factors. FIXIN IT, LLC will make reasonable efforts to meet appointments and timelines, but schedules are estimates unless specifically stated in writing. Delays caused by weather, supplier delays, customer availability, hidden conditions, unsafe areas, material changes, permits, HOA issues, landlord approvals, subcontractors, utilities, or other conditions do not void the quote or payment obligations. FIXIN IT, LLC is not liable for inconvenience, lost income, lost rent, loss of use, business interruption, schedule changes, or consequential damages from delays.
12. Site Access and Work Area Preparation
The customer must provide safe, reasonable, and timely access to the property and work area. Customer responsibilities may include moving furniture and personal property, clearing work areas, securing pets, keeping children and occupants away, providing parking, utility access, water, power, restroom access, unlocking gates and access points, removing fragile or valuable items, notifying tenants or security, and providing codes or instructions. If access is unavailable or the site is not ready, trip charges, wait time, rescheduling fees, or lost labor time may apply.
13. Safety and Right to Stop Work
FIXIN IT, LLC may refuse, pause, reschedule, or stop work if conditions are unsafe, unsuitable, misrepresented, hostile, unsanitary, hazardous, or outside the agreed scope. Reasons may include unsafe electrical or plumbing conditions, structural instability, mold, sewage, pests, asbestos, lead, hazardous materials, active leaks, aggressive animals, threatening behavior, lack of access, non-payment, customer interference, weather, lack of approvals or permits, or discovery of work outside handyman-level scope. If work is stopped, the customer remains responsible for completed work, time on site, purchased materials, mobilization, trip charges, administrative time, and incurred costs.
14. Permits, Codes, HOA Rules, and Approvals
Unless specifically stated in writing, the customer is responsible for identifying and obtaining required permits, inspections, HOA approvals, landlord approvals, property management approvals, architectural review approvals, utility approvals, or other permissions. FIXIN IT, LLC may assist only when included in the quote. Permit fees, inspection fees, drawings, engineering, administrative time, revisions, corrections, utility coordination, or code-required changes are excluded unless stated. FIXIN IT, LLC is not responsible for delays, fines, rejections, stop-work orders, HOA violations, landlord disputes, or costs from missing approvals or undisclosed restrictions.
15. Utilities, Underground Lines, and Hidden Systems
The customer is responsible for identifying and disclosing utilities, irrigation, septic, drains, underground cables, low-voltage wiring, invisible fences, landscape lighting, gas, water, electrical, communication lines, and other hidden systems. Unless included in the quote, FIXIN IT, LLC does not locate underground utilities or hidden systems. The customer is responsible for utility locates or specialty locating services. FIXIN IT, LLC is not responsible for damage to undisclosed, unmarked, improperly installed, shallow, abandoned, hidden, or unknown utilities or systems.
16. Hazardous Materials and Environmental Conditions
FIXIN IT, LLC does not perform hazardous material remediation unless specifically agreed in writing and legally permitted. Hazardous or unsafe conditions may include mold, asbestos, lead paint, sewage, biohazards, animal waste, chemical contamination, pests, rodent contamination, unsafe wiring, gas leaks, structural instability, contaminated water, fire damage, smoke damage, dangerous dust, or debris. Work may stop until evaluated, remediated, or corrected by appropriate professionals. Additional costs, delays, cleanup, testing, repairs, or specialty services are the customer's responsibility.
17. Specific Service Limitations
Plumbing-related handyman services are limited to appropriate basic tasks and do not guarantee existing systems are properly installed, code-compliant, leak-free, or in good condition. Electrical-related handyman services are limited to appropriate tasks where permitted and do not guarantee existing electrical safety, capacity, or compliance. HVAC, dryer vent, coil cleaning, debris removal, duct or vent cleaning, pressure washing, gutter cleaning, roof access, deck, fence, gate, railing, exterior woodwork, screens, windows, doors, furniture assembly, mounted items, lawn care, yard cleanup, and outdoor services are limited by access, safety, existing conditions, product quality, weather, materials, hidden defects, and the written scope. Repairs to part of a system or structure do not guarantee the condition of the entire system or structure.
18. Card on File Requirement
All projects require a valid credit card, debit card, ACH authorization, or other approved payment method on file before work is scheduled or performed unless FIXIN IT, LLC agrees otherwise in writing. By providing a payment method, the customer authorizes FIXIN IT, LLC and its payment processors to securely store and charge it for deposits, completed work, balances, approved change orders, materials, trip charges, service calls, late fees, declined payment fees, collection costs, and other amounts due. FIXIN IT, LLC does not directly store full card numbers.
19. Deposits, Mobilization, and Progress Payments
FIXIN IT, LLC may require a deposit before scheduling, reserving labor, purchasing materials, ordering special items, renting equipment, coordinating subcontractors, or beginning work. Deposits may be applied toward labor, materials, scheduling, mobilization, administrative time, project preparation, and other costs. Deposits, mobilization, purchased materials, special-order materials, custom items, opened materials, scheduled labor, administrative time, and preparation costs may be non-refundable once incurred. Larger projects may require progress payments.
20. Payment Due Upon Completion
Unless otherwise stated in writing, remaining balances are due immediately upon substantial completion. The customer may not withhold full payment for completed work due to unrelated issues, customer-requested additions, hidden conditions, cosmetic preferences, delays outside FIXIN IT, LLC's control, warranty review, minor punch-list items, or work not included in the original quote. Workmanship concerns must be reported promptly and FIXIN IT, LLC must be given a reasonable opportunity to inspect and address them. Undisputed amounts remain due.
21. Authorization to Charge Payment Method on File
Unless otherwise stated in writing, the customer authorizes FIXIN IT, LLC to charge the payment method on file upon completion for any remaining balance due and for approved change orders, additional work, materials, service calls, trip charges, late fees, declined payment fees, collection-related costs, cancellation fees, administrative fees, and any other owed amounts. The customer agrees not to initiate a chargeback or payment reversal for valid charges. If one is initiated, the customer remains responsible for unpaid balances and related fees, costs, attorney fees, and collection expenses to the extent permitted by law.
22. Declined Payments, Late Fees, and Reattempted Charges
If payment is declined, fails, is reversed, charged back, or cannot be processed, the unpaid balance is immediately past due. FIXIN IT, LLC may attempt to process the payment method on file once per day until paid. A $25 late payment, declined payment, or administrative fee may be applied for each day payment remains unpaid after a declined or failed attempt, to the maximum extent permitted by law. The customer is responsible for unpaid balances, late fees, declined payment fees, processing costs, collection costs, attorney fees, lien-related costs, court costs, filing fees, and other collection expenses.
23. Past Due Accounts and Collection Remedies
If payment is not received when due, FIXIN IT, LLC may suspend work, cancel remaining services, withhold scheduling, stop work, withhold warranty service, and begin collection efforts. If unpaid for 14 calendar days after completion, invoice due date, or declined payment, FIXIN IT, LLC may pursue lawful remedies including payment attempts, written demand, collection agency, attorney referral, small claims or civil court, mechanic's lien or materialman's lien where applicable, and recovery of costs where permitted by law.
24. Mechanic's Lien and Property Claim Notice
To the extent permitted by law, FIXIN IT, LLC reserves all rights to file, record, serve, enforce, or pursue a mechanic's lien, materialman's lien, property claim, lawsuit, or other lawful remedy for unpaid labor, materials, services, improvements, repairs, or related charges. Failure to pay may result in legal and administrative costs and may create a claim against the property. Nothing waives lien rights, collection rights, contract rights, payment rights, or legal remedies. The customer agrees to provide accurate ownership, billing, and contact information when needed.
25. Taxes, Fees, and Surcharges
The customer is responsible for applicable taxes, fees, permit charges, disposal fees, delivery fees, processing fees, convenience fees, financing charges, government fees, material surcharges, fuel surcharges, or other charges unless included in the quote. FIXIN IT, LLC may separately list labor, materials, taxable items, non-taxable items, trip charges, service fees, administrative fees, or other charges as appropriate.
26. Cancellations and Rescheduling
Customer cancellations, postponements, or rescheduling requests may be subject to fees if labor has been reserved, materials purchased, subcontractors scheduled, equipment rented, or project preparation begun. FIXIN IT, LLC may charge for time, materials, trip costs, administrative work, restocking fees, supplier fees, lost labor time, mobilization, and expenses incurred before cancellation. Repeated cancellations, lack of access, or lack of readiness may result in cancellation and billing for incurred costs.
27. Service Calls, Diagnostics, and Evaluations
Service calls, diagnostics, walkthroughs, inspections, troubleshooting, consultations, and evaluations may be billable whether or not repairs proceed. Diagnostic or evaluation services are based on visible and reasonably accessible conditions and do not guarantee identification of every issue, defect, code concern, hidden condition, or future failure. Troubleshooting time is billable even if the issue cannot be fully resolved, requires parts, additional visits, or a specialty contractor.
28. Warranty and Workmanship
Unless otherwise stated in writing, FIXIN IT, LLC provides a limited workmanship warranty for 30 days after completion on labor performed by FIXIN IT, LLC. It applies only to defects in workmanship directly caused by FIXIN IT, LLC and only to specific work performed and paid in full. It does not apply to customer-provided materials, manufacturer defects, product failure, normal wear, abuse, neglect, existing or hidden conditions, water damage, rot, mold, pests, structural movement, weather, work altered by others, temporary repairs, inherent cosmetic imperfections, paint or texture matching, caulk, grout, sealant, exterior repairs affected by movement or weather, customer-directed work against recommendation, work outside scope, or unpaid items. Warranty requests must be reported promptly in writing and FIXIN IT, LLC must be given a reasonable opportunity to inspect and correct issues before other remedies are pursued.
29. No Guarantee of Existing Systems, Structures, or Materials
FIXIN IT, LLC does not guarantee the condition, performance, lifespan, safety, or code compliance of existing systems, structures, fixtures, materials, appliances, surfaces, framing, wiring, plumbing, HVAC, roofing, siding, decking, fencing, drainage, or prior work by others. Working around existing materials does not create responsibility for the overall condition of the property or surrounding systems.
30. Pre-Existing Damage, Fragile Materials, and Matching Limitations
Older, worn, deteriorated, brittle, improperly installed, or fragile materials may crack, break, fail, shift, leak, detach, chip, peel, or become damaged during normal repair, removal, cleaning, adjustment, installation, or replacement. FIXIN IT, LLC is not responsible for damage caused by deterioration, improper installation, defective products, weakened surfaces, hidden defects, prior repairs, age, brittleness, rot, moisture, pests, or conditions not reasonably identified before work began. Matching paint, texture, wood, stain, caulk, grout, tile, siding, flooring, brick, concrete, metal, plastic, screen, trim, or finish may not be exact.
31. Limitation of Liability
To the fullest extent permitted by law, FIXIN IT, LLC is not liable for indirect, incidental, consequential, special, punitive, exemplary, emotional, economic, or loss-of-use damages, including lost profits, lost income, lost rent, business interruption, inconvenience, loss of use, temporary housing costs, missed deadlines, delayed occupancy, hidden conditions, customer-provided materials, existing defects, damage caused by others, or damage outside approved scope. FIXIN IT, LLC's total liability for any claim related to a project shall not exceed the amount actually paid for the specific work giving rise to the claim, except where prohibited by law.
32. Customer Indemnification
To the fullest extent permitted by law, the customer agrees to defend, indemnify, and hold harmless FIXIN IT, LLC and its owners, members, managers, employees, contractors, subcontractors, agents, vendors, and representatives from claims, damages, losses, liabilities, costs, expenses, attorney fees, and demands arising out of customer-provided information or materials, customer-directed work, unsafe site conditions, hidden or pre-existing conditions, failure to disclose known issues, failure to obtain permits or approvals, unauthorized requests, damage caused by occupants, tenants, pets, guests, other contractors, or third parties, misuse or alteration of completed work, or claims by owners, landlords, tenants, HOAs, neighbors, or third parties related to customer-requested work.
33. Insurance and Risk of Loss
The customer is responsible for maintaining appropriate property, homeowner's, renter's, landlord, business, flood, casualty, and other insurance coverage. FIXIN IT, LLC is not responsible for losses that should be covered by customer insurance, including water damage, storm damage, fire damage, theft, vandalism, mold, rot, structural defects, hidden defects, acts of God, or property losses outside the specific approved scope.
34. Subcontractors, Helpers, Vendors, and Third Parties
FIXIN IT, LLC may use employees, helpers, subcontractors, specialty contractors, suppliers, vendors, delivery providers, software providers, payment processors, or other third parties. Subcontractors or specialty contractors may be subject to their own licensing, insurance, scheduling, warranty, and service terms. FIXIN IT, LLC may coordinate such work when appropriate but is not responsible for services outside its direct control unless required by law.
35. Photos, Videos, Documentation, and Records
FIXIN IT, LLC may take photos, videos, measurements, notes, call recordings, call transcriptions, screenshots, inspection notes, before-and-after images, and other documentation for estimating, scheduling, customer communication, work documentation, training, quality control, dispute resolution, insurance, collection, warranty review, and business records. Customer-identifying photos, videos, or private property information will not intentionally be used for public marketing without permission unless already public or legally permitted. Documentation may be retained as business records.
36. Call Recording and Transcription Notice
Calls with FIXIN IT, LLC may be recorded and transcribed for training, quality assurance, customer service, documentation, dispute resolution, internal review, and business improvement. By calling, receiving a call, continuing a phone conversation, or otherwise communicating by phone, the customer acknowledges and consents that the call may be recorded and/or transcribed. If a customer does not wish to be recorded, they should notify FIXIN IT, LLC at the beginning of the call or communicate by email at info@fixinitsc.com.
37. SMS/Text Messaging Terms
FIXIN IT, LLC may communicate by SMS/text message regarding appointments, scheduling, service updates, estimates, invoices, payments, customer support, and related business matters. By providing a mobile phone number, submitting a form, requesting a quote, booking service, or otherwise opting in, the customer consents to receive SMS and/or MMS messages from FIXIN IT, LLC. Message frequency may vary. Message and data rates may apply. Customers may opt out by replying STOP and may reply HELP for assistance or contact info@fixinitsc.com. Mobile phone numbers, SMS opt-in data, and SMS consent information will not be sold or shared with third parties or affiliates for their own marketing or promotional purposes.
38. Privacy Policy
FIXIN IT, LLC's Privacy Policy explains how customer information is collected, used, stored, and shared. The Privacy Policy is available at www.fixinitsc.com/privacy-policy. By using our website, requesting service, communicating with us, approving a quote, or providing information, the customer agrees to the Privacy Policy.
39. Website Use
The FIXIN IT, LLC website is provided for general information, customer communication, service requests, and business purposes. Website content is not professional legal, engineering, architectural, financial, insurance, or code advice. FIXIN IT, LLC may update, remove, revise, or modify website content at any time and does not guarantee website information is complete, current, error-free, or applicable to every property or request. Customers may not misuse the website, submit false information, attempt unauthorized access, interfere with functionality, or use the website unlawfully.
40. Intellectual Property
All FIXIN IT, LLC names, branding, logos, website content, text, images, service descriptions, documents, templates, forms, and business materials are owned by or licensed to FIXIN IT, LLC unless otherwise stated. Customers may not copy, reproduce, distribute, modify, publish, or use materials for commercial purposes without written permission.
41. Reviews, Feedback, and Communications
Customers may provide reviews, feedback, testimonials, comments, messages, or communications regarding FIXIN IT, LLC. By providing feedback or reviews directly, the customer grants FIXIN IT, LLC permission to use non-private feedback for business improvement and marketing unless the customer requests otherwise in writing. FIXIN IT, LLC will not intentionally publish private customer information, private addresses, or customer-identifying project details without permission unless legally permitted.
42. Force Majeure
FIXIN IT, LLC is not responsible for delay, failure, or inability to perform caused by events outside reasonable control, including weather, storms, natural disasters, fire, flood, illness, injury, labor shortages, material shortages, supplier delays, equipment failure, power outages, transportation issues, acts of government, permitting delays, civil unrest, pandemics, emergencies, or other unforeseen events.
43. Dispute Resolution and Opportunity to Cure
The customer agrees to notify FIXIN IT, LLC in writing of any concern, dispute, alleged defect, or requested correction within a reasonable time after discovery. Before initiating a chargeback, hiring another contractor to correct work, filing a claim, posting a complaint related to a disputed workmanship issue, or pursuing legal action, the customer agrees to provide FIXIN IT, LLC a reasonable opportunity to inspect and attempt to resolve it. Failure to do so may limit remedies. Undisputed amounts remain due.
44. Chargebacks and Payment Disputes
The customer agrees not to file a chargeback, payment reversal, or payment dispute for valid charges related to approved work, completed work, deposits, materials, trip charges, administrative fees, late fees, or other amounts due. If a chargeback is filed, FIXIN IT, LLC may provide documentation including quotes, approvals, invoices, communications, photos, work records, call recordings, transcriptions, and these Terms. The customer remains responsible for unpaid balances, chargeback fees, collection fees, attorney fees, court costs, lien costs, and related expenses to the extent permitted by law.
45. Governing Law and Venue
These Terms and any dispute related to FIXIN IT, LLC's services shall be governed by South Carolina law, without regard to conflict-of-law principles. To the extent permitted by law, legal action shall be brought in a court of competent jurisdiction in South Carolina. Venue may be based on the property, customer, or FIXIN IT, LLC's principal business location as permitted by law.
46. Severability
If any provision is found invalid, unlawful, or unenforceable, remaining provisions remain in full force and effect. The invalid provision shall be modified or interpreted to the minimum extent necessary to make it enforceable, if permitted by law.
47. No Waiver
Failure by FIXIN IT, LLC to enforce any right, term, condition, or remedy does not waive the right to enforce it later. Any waiver must be in writing and signed by FIXIN IT, LLC.
48. Assignment
FIXIN IT, LLC may assign, subcontract, transfer, or delegate rights or obligations under these Terms as part of business operations, collections, subcontracting, sale of business assets, or other lawful business purposes. The customer may not assign rights or obligations without written permission.
49. Entire Agreement
The approved quote, these Terms, written change orders, written project notes, invoices, and written communications from FIXIN IT, LLC represent the agreement for the work. No verbal statement, assumption, prior discussion, or customer expectation changes these Terms unless confirmed in writing by FIXIN IT, LLC. If these Terms conflict with a project-specific written quote, the quote controls only for that specific conflicting item.
50. Updates to These Terms
FIXIN IT, LLC may update or modify these Terms at any time. Updated Terms will be posted on this page with a revised effective date. For approved quotes, Terms in effect at the time of quote approval generally apply unless the customer approves updated Terms, requests additional work after updates are posted, or otherwise agrees. Continued use of the website, services, communication systems, or quote approvals after updates are posted means acceptance of updated Terms for future services.
